As difficult times have hit timeshare giant, Club La Costa, members are drastically attempting to recover the thousands of pounds that they have spent. The big question now is, “will Club La Costa members receive a refund?” Unfortunately, Club La Costa members will not receive a refund by the resort directly.
However, there is hope for some Club La Costa owners in recovering money back if the timeshares had been mis-sold. But this is not refunded by the resorts. Depending on how and when you paid, you could claim money back from credit providers.
There has been a huge influx of Club La Costa owners reaching out to timeshare claims management companies over the past month. This has caused a bit of a queue but there is still time for some members.
Did you pay by credit card?
There is still time, but you may need to act quickly. There are a few avenues that timeshare owners can take to be compensated. One of the routes available for timeshare owners is to claim under Section 75 of the Consumer Credits Act. This could be available for anyone who has paid even a small amount of the purchase price via a credit card.
Section 75 is an insurance policy that covers consumers on the sales of products that had been mis-sold. Mis selling can cover a range of things, such as products not being as described. For example, if you were sold your timeshare based on the timeshare resorts or memberships being exclusive to its owners, and now find that guests can book the accommodation directly with the hotel or online booking sites, this means that the product received was not as described when sold.
This is not available for every timeshare owner and the refunded amount can come from the timeshare resort or credit supplier. There are factors to consider such as the year you purchased and type of product (fixed weeks, points or fractional ownerships).
Did you purchase a Fractional ownership?
Timeshare claims management companies are filing claims for owners who purchased fractional timeshares, full title deeds and point based products. This type of claim is not 100% guaranteed and is a lengthier process the the simple Section 75 claims.
If you cannot find the information you need on our website, you can arrange a free telephone consultation to find out where you stand with your timeshare. However, these appointments are limited due to the high demand caused by the closure of multiple timeshare resorts.
You can also use our simple online compensation calculator to find out if you are eligible to claim compensation. Due to the complexity of some timeshare products a member of our team may need to contact you for further information.
